Orders by Consent and Terms of Settlement

This is our preferred method of settlement either by way of parties entering into Orders by consent for children and/or property. Terms of Settlement are entered into when parties are already in the midst of proceedings and they arrive at an agreement by mutual consent.

Bopth forms of settlement requires the Court to consider whether the terms of the settlement are 'just and equitable' or in the case of children in the 'best interests' among other considerations.

Orders by consent often take slightly longer to execute given the Court is required to review them. By comparison a BFA immediately applies upon proper execution and also avoids the consideration of the terms by the Court.
